A suspect was arrested and charged with aggravated battery with a firearm in connection with an early morning shooting Thursday.

At about 2:09 a.m., DeLand police officers were dispatched to a parking lot area in the 100 block of E. Indiana Avenue in reference to a person shot.

The preliminary investigation revealed the suspect, identified as Joshua Jones (DOB: 10/07/1987), and the victim 52-year-old Curtis Criche had been drinking at a local bar when a verbal argument carried over into the parking lot and roadway.

Jones, who was in a black SUV, pulled out a gun and fired it toward Criche who was standing outside of the SUV on E. Indiana Avenue. The bullet appeared to ricochet off the ground, hitting Criche with bullet fragments.

The preliminary investigation indicates Jones then drove east on Indiana Avenue, firing about nine more rounds. Jones briefly left the scene, circling back to the area where witnesses pointed him out to responding officers. Units conducted a felony stop, taking him into custody.

Jones was transported to the Volusia County Branch Jail where he is charged with aggravated battery with a firearm and unlawful discharge of a firearm.

No other injuries were reported. The victim suffered non-life threatening injuries to his lower legs and is in stable condition.

This is an active and ongoing investigation.
