As the chair of the Volusia County Libertarian Party, I feel compelled to respond to the recent letter criticizing our support for Green Party presidential candidate Jill Stein following her arrest. The letter, published May 14, suggests that Dr. Stein’s arrest for assaulting a police officer and criminal trespass are not protected acts under the First Amendment.

While it is true that the First Amendment does not grant the right to trespass or engage in violence, the charges against Dr. Stein must be carefully examined. Historical instances of protest and civil disobedience have often been met with exaggerated or politically motivated charges, particularly when they challenge powerful institutions. We must differentiate between actual criminal behavior and the misuse of legal charges to suppress legitimate dissent.

A separate video reposted by Dr. Stein shows police officers pushing a bicycle into her as they clashed with her and other protesters. Such actions raise serious concerns about the nature of the arrest and the potential for excessive force or provocation by law enforcement. Peaceful protest and civil disobedience are long-standing methods of advocating for change and are protected forms of political expression.

The letter’s comparison of peaceful protesters to “fascist thugs” is a dangerous mischaracterization. This language conflates nonviolent civil disobedience with genuinely criminal actions, undermining the essence of democratic engagement. Our democracy thrives on robust debate and the ability to challenge the status quo without fear of unwarranted reprisal.

While concerns about federal and tech-company censorship are valid, it is inconsistent to advocate for punitive measures against peaceful protesters. Protecting free speech means defending all forms of nonviolent expression, even when we disagree with the message or the methods.

Lastly, the presumption of innocence is a cornerstone of our legal system. Dr. Stein, like any citizen, deserves this presumption and a fair trial. If found guilty of legitimate criminal actions, she should face appropriate consequences. However, advocating for pre-emptive punishment without due process contradicts the principles of justice and liberty we hold dear.

In conclusion, we must ensure that laws are upheld and public order maintained, but also guard against the erosion of civil liberties through the misuse of legal charges to stifle dissent. The Libertarian Party of Volusia County stands firmly in support of the constitutional rights to free speech and peaceful assembly, and will continue to defend these principles against all forms of encroachment.
