A DeLand Police officer drove up to a convenience store and saw a 57-year-old man sitting outside on a chair with an open container. The man was smoking a cigarette with his right hand and also holding a brown paper bag in that same hand, under his right thigh. The officer told the man he “was not allowed to have open containers on the business property.”

The fellow “grabbed his alcoholic beverage (Busch light) which was in [the] brown paper bag and turned his body as to conceal the brown bag along with cash within his left hand.”

The officer asked Brown Bag Guy what was in the bag, and the guy said there was nothing in it.

Brown Bag Guy “then proceeded to the nearest garbage bin … [and] threw in the crumpled brown bag and cash prior to tossing the emptied beer can.”

Officer asked him why he’d had the bag hidden under his thigh. Brown Bag Guy said, “I just came out the store I was sitting down sir, that’s what it was, I seen you pull up…”

Officer pulled the bag out of the garbage bin and found a “white rock-like substance” in the bag. Brown Bag Guy said, “I smoke.” Officer found no paraphernalia or other drugs on him, so he asked how Brown Bag Guy was going to smoke the rock, to which he replied, “I got a pipe at home, in Deltona.”

The white substance tested presumptive positive for cocaine.

Brown Bag Guy said the bag that had crack cocaine in it was not his, that he found the bag on the chair, and that he didn’t know it contained crack because he didn’t look in it. He also said he didn’t have a stem with which to smoke crack.

Officer “asked him if he did have a stem would he have smoked it,” and he said yes.

Brown Bag Guy was taken to jail.

Some people talk too much for their own good.
